By accessing or using the Website, scheduling a service, or submitting a request for inspection, you agree to be legally bound by these Terms. If you do not agree to these Terms, you should not use the Website or proceed with any service request.

These Terms form a legally binding agreement between you (“you,” “your,” or “Client”) and Midwest Aerobiology Labs. Please read them carefully. They contain important disclaimers, limitations of liability, and provisions that affect your legal rights.

This Website and the Services are intended for use by residents of the United States who are at least 18 years of age. By using the Website, you represent and warrant that you meet these eligibility requirements.

1. Service Description

The Website, www.knowmold.com, serves as an online platform through which users can explore environmental testing services offered by Midwest Aerobiology Labs, view service categories, and submit inspection or consultation requests. The Website is intended to facilitate service awareness and appointment scheduling only; it does not offer digital testing, analysis, or immediate diagnostic services.

Available service offerings may include, but are not limited to:

  • Post-Remediation Verification (PRV)
  • Attic-Specific Mold Assessments
  • Intrusive Mold Investigations

The exact scope of each service is defined in the corresponding package description at the time of booking. These services are offered on a test-only, consultation-based model, and do not include mold remediation, construction, or repair services.

2. Inspection Scope and Limitations

 

All inspections conducted by the Company are based on observations, measurements, and sampling performed during a scheduled site visit. The scope of inspection is inherently limited by several factors, including environmental conditions, property layout, material accessibility, and client authorization.

Clients acknowledge and agree to the following limitations:

  • Visual and Accessible Areas Only: Inspections are limited to areas that are safely accessible and visible at the time of the visit. We do not open wall cavities, move furniture or appliances, or dismantle HVAC systems unless explicitly stated in the chosen service package and agreed upon in writing.
  • Environmental Snapshot: All testing results and environmental readings (e.g., humidity, temperature, moisture) reflect conditions observed at the specific time of inspection and are not predictive of future conditions or changes.
  • No Code or Structural Evaluation: The Company does not evaluate properties for code compliance, structural integrity, or mechanical system functionality. Observations made during inspections should not be interpreted as engineering, architectural, or construction advice.
  • Non-Exhaustive Findings: Although our inspection methods are professional and systematic, inspections are not exhaustive. It is possible for microbial growth or moisture intrusion to exist in areas not tested or observable during the inspection.
  • Sampling Interpretation Limits: Air and surface samples provide information about the presence or absence of mold spores or microbial material at the time of collection. However, laboratory analysis does not quantify risk, health impact, or extent of contamination in inaccessible areas.
  • Client Responsibility for Remediation Decisions: The Company provides factual findings and objective data only. It is the Client’s responsibility to consult qualified remediation professionals for further investigation, cost estimation, or corrective work based on our reports.
  • Technician Discretion: Field technicians may decline to perform specific tasks or collect samples if, in their professional judgment, conditions are unsafe, unreasonable, or outside the scope of the agreed service.

By proceeding with an inspection, Clients agree to these limitations and understand that the findings represent a point-in-time professional observation — not a guarantee of complete mold presence or absence in the property.

3. Booking and Payment

 

Submission of a service request through the Website does not constitute a confirmed booking. All inspection appointments are subject to approval and availability. The Company will confirm the requested service in writing, typically via email, along with any relevant scheduling details. Only upon confirmation does a binding service arrangement exist between the Client and the Company.

Prices listed on the Website reflect standard package rates at the time of display. The Company reserves the right to adjust pricing prior to confirmation in the event of clerical errors, service scope clarification, or special requirements not reflected in the original request. All pricing is denominated in U.S. dollars and subject to applicable local taxes.

Unless otherwise agreed in writing, full payment is due in advance of service. Payment must be submitted via an approved method designated by the Company. The Company reserves the right to cancel any scheduled service in the event of non-payment, payment dispute, or inability to verify the booking details.

Clients are responsible for ensuring that billing information is complete and accurate at the time of payment. Failure to provide updated or valid payment credentials may result in service delay or cancellation.

4. Information Accuracy and Website Content

 

The content, service descriptions, pricing, and informational material presented on knowmold.com are provided for general informational purposes only. While the Company strives to ensure that all content on the Website is accurate, complete, and up to date, we do not guarantee that all information will be error-free, current, or applicable to every situation.

Midwest Aerobiology Labs expressly disclaims any liability for reliance on information displayed on the Website that is outdated, general in nature, or no longer reflective of current service offerings or procedures. Clients are responsible for reviewing the most recent version of any service package and confirming the scope of service with the Company prior to inspection.

Descriptions of services, inspection inclusions, or sample results provided on the Website may be revised or updated without prior notice. The Website may contain legacy language that does not reflect operational updates or current inspection protocols. Submission of an inspection request through the Website does not create any entitlement to services beyond those confirmed in writing by
the Company.

The Company is not liable for damages or losses resulting from reliance on Website content for decision-making purposes, including but not limited to remediation planning, real estate transactions, health concerns, or dispute resolution. Users are encouraged to contact the Company directly for clarification on any aspect of the services offered before submitting a request or
relying on Website content.

5. User Obligations

 

By using this Website and submitting a request for services, you agree to the
following:

  • Accurate Information: You agree to provide complete, current, and accurate information at the time of booking or communicating with the Company. This includes property details, service location, contact information, and any relevant notes regarding access, site conditions, or concerns. The Company is not responsible for delays, errors, or inability to perform services resulting from inaccurate or incomplete information provided by the Client.
  • Authority to Request Services: By submitting a service request, you represent and warrant that you are:
    • i. The legal owner of the property where the inspection is to occur; or
    • ii. An authorized agent, tenant, or representative with permission to request and consent to inspection services on the property owner’s behalf.

      If it is later determined that you did not have appropriate authority to request services, you agree to assume full responsibility for any resulting costs, claims, or liability.

  • Safe and Reasonable Access: You agree to ensure that the inspection site is accessible and safe at the scheduled appointment time. This includes providing entry to relevant areas of the property and notifying the Company in advance of any known hazards, restricted areas, animals, or site-specific considerations. If access is denied, obstructed, or unsafe, the technician may cancel or postpone the inspection at their discretion, and the Company reserves the right to retain part or all of the service fee to cover travel or time expenses.
  • Use of Website: You agree not to use this Website:
    • i. To impersonate another person or entity;
    • ii. To misrepresent your identity or intentions;
    • iii. To submit false service requests;
    • iv. Or to interfere with the operation or security of the Website.

      The Company reserves the right to suspend or deny service to any user who violates these obligations or abuses the platform.

6. Intellectual Property

 

All content on this Website, including but not limited to text, graphics, service descriptions, logos, icons, images, data compilations, videos, downloadable documents, reports, inspection templates, and the Website’s overall design and layout, is the exclusive property of Midwest Aerobiology Labs or its content suppliers and is protected by applicable U.S. and international intellectual
property laws.

This includes any proprietary explanations of services, sampling methodologies, report formatting, and recommendations provided in written or digital form.

No portion of this Website may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way — including for commercial use — without the express prior written consent of the Company. To the fullest extent permitted by law, Midwest Aerobiology Labs shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, including but not limited to property damage, business interruption, loss of data, loss of profits, or personal injury, arising out of or in connection with:

  • The use of or reliance upon the Website or its content;
  • The booking, performance, or outcome of any inspection or consultation
    service;
  • The presence, absence, or interpretation of laboratory or field sampling results;
  • Any delay, rescheduling, or cancellation of a scheduled service;
  • Or any communication, recommendation, or information provided before, during, or after a service appointment.

The Company’s services are non-remedial and informational in nature, and inspection findings do not constitute health advice, legal advice, or remediation instructions. All findings are based on conditions observable at the time of service and do not represent a warranty, prediction, or guarantee of future environmental conditions.

In no event shall the total liability of the Company exceed the actual amount paid by the Client for the specific service in question. This limitation applies regardless of the legal theory asserted, whether in contract, tort (including negligence), strict liability, or otherwise.

Clients understand and agree that any decision to rely on the Company’s findings or reports — including for real estate transactions, remediation decisions, or personal health concerns — is made at the Client’s own risk and discretion. The Company shall not be liable for any outcomes resulting from third-party remediation actions, health-related decisions, or interpretations made by other individuals or organizations.

You agree to indemnify and hold harmless the Company, its officers, agents, and employees from and against any and all claims, liabilities, damages, costs, and expenses (including attorneys’ fees) arising out of your use of the Website, your breach of these Terms, or your misuse of any inspection service.

8. Third-Party Services

 

We may use third-party laboratories or contractors to assist in providing services. While we strive to work with reputable providers, we are not responsible for the actions, omissions, or performance of any third-party service providers.

9. Dispute Resolution

 

In the event of any dispute, claim, or controversy arising out of or relating to the use of the Website or the services provided by Midwest Aerobiology Labs, the parties agree to first attempt to resolve the matter through informal discussions
and good faith negotiation. Either party may initiate this process by providing written notice of the dispute, including a brief description of the issue and proposed resolution.

The parties agree to make reasonable efforts to communicate and resolve the issue within thirty (30) days of receipt of such notice before pursuing any formal proceedings.

If the dispute cannot be resolved through good faith negotiations within the time stated above, the matter shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA) or another mutually agreed arbitration provider. The arbitration shall take place in DuPage County, Illinois, and judgment on the award rendered by the arbitrator may be entered in any
court of competent jurisdiction.

The arbitration shall be conducted by a single neutral arbitrator and shall be limited to the dispute between the individual Client and the Company. Class or collective actions are not permitted.

Each party shall be responsible for its own legal fees, costs, and expenses unless the arbitrator rules otherwise in accordance with applicable law.

This arbitration provision shall survive the termination of these Terms and any use of the Website or services.

10. Miscellaneous

 

  • Entire Agreement: These Terms, together with the Privacy Policy and any written service confirmations or agreements issued by the Company, constitute the entire agreement between you and Midwest Aerobiology Labs regarding your use of the Website and
    the services offered. They supersede any prior oral or written communications, representations, or understandings.
  • Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable for any reason, the remaining provisions shall remain in full force and effect and shall be interpreted to best achieve the original intent of the parties.
  • No Waiver: The failure of the Company to enforce any provision of these Terms shall not be deemed a waiver of such provision or of the right to enforce it in the future. Any waiver must be in writing and signed by an authorized representative of the Company.
  • Assignment: You may not assign or transfer your rights or obligations under these Terms without the prior written consent of the Company. The Company may assign its rights and obligations without restriction.
  • Force Majeure: The Company shall not be liable for any delay or failure to perform its obligations under these Terms due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, labor disputes, pandemics, technical failures, or government actions.
  • Electronic Communications and Signatures: You consent to receive communications from us electronically and agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing. You also agree that your submission of any electronic form or checkbox acknowledgment constitutes your legally binding electronic signature.
